SnifferCat, Inc. d/b/a MuxIP (“MuxIP”) respects your privacy. This Privacy Policy describes how and why we collect, use, disclose, store and otherwise process data through our services and through this website.

Who We Are

MuxIP provides technology services (the “MuxIP Services”) that allow third parties to monetize and distribute content directly to end viewers Internet technologies (sometimes known as “Over-the-Top” or “OTT” media services).   We provide the MuxIP Services to video content providers who distribute their content via OTT (“Content Providers”).  We also work with OTT content distribution platforms (“OTT Platforms”) to distribute and monetize the video content of Content Providers.  The video advertising that is enabled through the MuxIP Services may come from Content Providers or OTT Platforms.  We also deliver or enable Content Providers and OTT Platforms to deliver video advertising provided by third-party advertising networks and exchanges (“Ad Networks”).

MuxIP Services

Information We Receive Through the MuxIP Services

Generally, MuxIP does not collect or receive information through the MuxIP Services that identifies a user directly (for example, we do not collect information such as name, username, email address, or a mailing address).

Instead, when a user watches video content from our Content Partners or through OTT Platforms we support, we may automatically receive the following information (“Logged Information”):

  • IP address

  • Identifiers assigned to the user’s device, such as device ID and user agent.

  • Session ID

  • Time Stamp

  • Country latitude and longitude

  • Device make, model, and brand name

Generally, the Logged Information is passed to us through the Content Provider or OTT Platform that delivers the content to a user. 

We will not combine Logged Information with any information that identifies a user without the user’s express consent.

How We Use Logged Information

We do not sell Logged Information to third parties, and we will not otherwise disclose Logged Information to third parties, without your express permission or as expressly disclosed in this Privacy Policy

We use Logged Information for the following purposes:

  • To provide, maintain, secure, and improve the MuxIP Services;

  • To identify and prevent improper or fraudulent behavior; and

  • To account for video advertising delivered through the MuxIP Services and to permit Content Providers, OTT Platforms and Ad Networks reconcile payments for such video advertising.

How We Share Logged Information We Collect

MuxIP may share Logged Information with certain third parties for lawful purposes.

Sharing with Service Providers

We may sometimes use other businesses (“Service Providers”) to perform certain services for us or on our behalf, such as hosting and maintenance, data storage and management services. We provide our Service Providers with the information reasonably necessary for them to perform the services on our behalf.  Each Service Provider must agree to implement and maintain reasonable security procedures and practices appropriate to the nature of the information involved in order to protect your information from unauthorized access, destruction, use, modification or disclosure.

Sharing with Content Providers, OTT Platforms and Ad Networks

MuxIP may share Logged Information with Content Providers, OTT Platforms and Ad Networks regarding when and how ads were displayed. Generally, we share this data in an aggregated or de-identified format. We share this information with them for reporting purposes.

Additional Sharing with Ad Networks

MuxIP shares Logged Information with Ad Networks for the purpose of allowing Ad Networks to bid on available video advertising inventory and deliver video ads through the MuxIP Services.

Other Legal Purposes

MuxIP may access, preserve, and disclose any information as required for legal purposes, including:

  • In response to subpoenas, court orders, or legal process, or to establish, protect or exercise our legal rights or defend against legal claims;

  • To protect the rights and property of MuxIP, Content Providers, OTT Platforms and Ad Networks, and other business partners (including advertisers), our licensors, or the public;

  • If we believe it is necessary in order to investigate, prevent or take action regarding illegal activities, fraud, or violations of the personal or intellectual property rights of others or situations involving potential threats to the safety of any person;

  • To our corporate affiliates, joint ventures or other companies under common control with MuxIP (in which case we will require such entities to honor this Privacy Policy); and,

  • If MuxIP is acquired by or merged with another entity or in connection with a sale of our assets.

Information you Choose to Submit

You may be asked to provide personal information in certain fields on this Website, such as an email address to be contacted by us or to sign up for our marketing list. Providing this information is strictly voluntary.

To do business with MuxIP (as a “Business Partner”), you may be asked to provide certain personal information, including your name, your company name, email address, physical address, phone number, tax identification information, accounting and bank information, and payment information (including credit card information).

Information We Automatically Collect

When you visit and use our Website, we may also automatically collect and use certain data.  We collect information in standard log files that may include your IP address, your Internet Service Provider (ISP), the Web browser you used to visit the Website, the time you visited the Website, which web pages you visited on the Website, and other usage data.

In addition, we may use a technology called “cookies” and similar identification technologies.  A cookie is a small file transferred to your computer or device that identifies you as a unique user.  We may use cookies to improve the quality of our Website and make it easier to use.  We do this by storing information (for example, settings preferences) about a particular user session in cookies in order to provide you with a seamless experience during your visits.  If you choose to do so, you can configure your browser to delete existing cookies or disable cookies altogether.  However, certain features of the website may not work if you delete or disable cookies.

How we Use Information We Collect

We do not sell your information to third parties, and we will not otherwise disclose your information to third parties, without your express permission or as expressly disclosed in this Privacy Policy

We may use your information to provide you information about the MuxIP Services, to notify you of new product releases and services, to conduct research, and to solicit your feedback and input about the MuxIP Services.

Any use of any personal information you voluntarily submit to the website for marketing, feedback and other notification purposes will be explained at the point of collection and limited to the purposes specified at that time.

Information Sharing and Disclosure

MuxIP may disclose information about Business Partners and visitors to the MuxIP Website with certain third parties for lawful purposes.

INFORMATION COLLECTED BY OTHERS

We do not control and are not responsible for the privacy practices of any third party, including, but not limited to, Content Providers, OTT Platforms, Ad Networks, Business Partners and any website or service that links to or from our Website or the MuxIP Services. Please be sure to review the privacy policies of any websites and applications that you may use.

This site may contain links to other sites. MuxIP is not responsible for the privacy practices or content of these other sites. When you leave our Website or view a portion of a third party’s site through our Website, you are responsible for reading the privacy policies of each such site. This Privacy Policy applies solely to information collected by MuxIP.

RIGHTS OF EUROPEAN UNION RESIDENTS

MuxIP complies with the European Union General Data Protection Regulation (“GDPR”). The GDPR requires that MuxIP take particular measures to protect the personal data of European residents. If there is any conflict between this policy and the GDPR, the GDPR principles shall govern with respect to residents of the European Union.

Under the GDPR, you have the right to withdraw consent that you have given us to process your personal data (Article 7); to request access to your personal data stored at MuxIP (Article 15 GDPR) and the right to data portability (Article 20). You also have the right to request corrections (Article 16 GDPR), deletion (Article 17 GDPR) or restriction (Article 18 GDPR) of your personal data stored at MuxIP.

If you are a European resident dissatisfied with the handling of your personal data by MuxIP, you have the right to object to processing of your personal data at any time (Article 21 GDPR). You also have the right to lodge a complaint with a supervisory authority.  You may send your concerns or objections about the processing of your personal data to privacy@muxip.com.

CALIFORNIA RESIDENTS

These additional notices are provided under the California Consumer Privacy Act (“CCPA”) and apply to California residents in addition to the other provisions of this Privacy Policy.

As described above, we do not sell information to any third party.

If you are a California resident, you have the following rights:

•    You may request, no more than two times each year, that we disclose to you the following for the 12-month period preceding our receipt of your request:

  • The categories of personal information we have collected about you;

  • The categories of sources from which the personal information is collected;

  • The business or commercial purpose for collecting your personal information;

•    You may request that we delete any personal information that we have collected from or about you.  Except as provided under the CCPA, we will delete such information in response to your request.

In order to respond to your requests, we may need to verify your identity. We will not discriminate against you in the provision of the Services in response to your exercise of these privacy rights. We will respond to your request within 45 days of receipt of your request, after verification, unless we need additional time, in which case we will let you know and may extend the period an additional 45 days as permitted by the CCPA.

CHILDREN

We do not engage in activities that require parental notice or consent under the U.S. Children’s Online Privacy Protection Act (COPPA).  If you believe that we have inadvertently collected information from a child under 13 that is subject to parental notice and consent under COPPA, please contact us using the contact information below to request deletion of such information.

When the European Union’s General Data Protection Regulation requires consent for the collection of personal data, we will not collect such personal data from End Users under 16 years of age (or such younger age as may be specified by the laws of a particular country).

SECURITY

We use standard security procedures and practices appropriate to the nature of the information in an effort to protect information from unauthorized access, destruction, use, modification or disclosure.  We also require our Service Providers to implement and maintain reasonable security procedures and practices appropriate to the nature of the information we share with them.

No data transmission over the Internet or any wireless network can be guaranteed to be 100% secure.  As a result, while we strive to protect your information, we cannot and do not guarantee or warrant the security of any information transmitted to or from the Services.

CHANGES TO THIS PRIVACY POLICY

We may amend this privacy policy from time to time. If we make a material change to this policy, we will notify you by posting notice of these changes on our Website home page and in this Policy.
